A properly drafted special needs trust can allow these individuals to qualify for certain government benefits, such as Social Security Disability Insurance (SSDI) or Medicaid, without having to spend down assets. If you have a child with special needs, you must provide for them upon your death or incapacity. I can help you establish a special needs trust in order to give your child the benefit of an inheritance or the proceeds of a legal settlement without disqualifying your child from SSDI and any other government benefits.
Another estate planning tool that can be used to help someone maintain eligibility for government benefits is a pooled trust. Money in a pooled trust can go to pay for needs over and above what is provided by Medicaid or SSDI. For instance, money in the pooled trust can be used to pay for a private room in a care facility, or other such upgrades. Upon the beneficiary's death, the money that remains in the trust will go to the state. A pooled trust works especially well for individuals over 65, individuals with no children, or individuals with children who are not financially dependent on their parents.
